Overstay in Indonesia. Violation of the Immigration Act.

There are instances where it becomes necessary to stay in Indonesia for a few days longer than is permitted by the visa or entry stamp. This could be due to a number of factors, including a convenient and affordable trip, illness, altered plans, etc.


A fine of IDR 1,000,000 per day of the delay is imposed for violating the stay in Indonesia. The compensation for overstaying is a lawful non-tax state revenue, not a bribe. Overstaying by up to 60 days is a breach of administrative law. It must be paid at the airport before to departure and has no severe repercussions. Just make sure you have the necessary funds on hand to cover the fine in full.

Overstay of more than 60 days is a crime according to the Indonesian law.

According to Indonesian legislation, overstaying for more than 60 days is against the law. The cost of such a delay is IDR 1,000,000 every day of the delay. The offender will be placed on a blacklist and denied entrance (deported). The law provides for up to five years in prison in the event that there are insufficient money to pay for the overstay.

The blacklist is not automatically updated. It would be quite challenging for you to return to Indonesia, even if you were expelled for six months. You will be flagged as having a prohibition on admission in the system as you pass the passport control.


PLEASE PAY ATTENTION! You must leave Indonesia's borders once the visa's validity period (including any extensions) is over. The holders of multiple-entry yearly business visas are required to depart Indonesia every 60 days. Any proposals from agents to extend a visa after it has expired or to extend an annual business visa are prohibited and may have very unfavorable results. The Immigration Act provides for up to a 5-year prison sentence and/or a fine of up to 500.000.000 IDR:


1. For all foreign nationals who intentionally entered, exited, or stayed on Indonesian territory using a fraudulent or falsified visa.


2. For anybody who knowingly provides a fake or forged visa with the goal to use it to enter, leave, or remain on Indonesian territory for themselves or a third party.


3. Immigration officers or other officials who willfully and unlawfully grant or extend immigration documents to people who do not have the right to do so will be punished with up to 7 years in prison. This punishment applies to anyone who uses immigration information and/or access to data for their own benefit or the benefit of third parties.
